TERMS OF SERVICE AGREEMENT
Helm Marine Inc. will treat every customer with the highest quality of service, respecting you and your lakeshore equipment. Helm Marine Inc. Barge Service schedule is based on wind, weather and road conditions. Helm Marine Inc. will do their very best to install and remove your lake equipment in the exact location requested. However, water levels, rocks, trees and other obstacles may prohibit the location and adjustments may need to be made based on Helm Marine Inc's best judgment at the time of install or removal. Helm Marine Inc. will treat all your lake equipment, pontoons, boats, PWC’s and other vessels with respect. Furthermore, Helm Marine Inc. is not responsible for damage to docks, boat lifts, pontoons, boats, PWC’s, decks, platforms and lakeshore landscaping due to deterioration of aging materials and/or prior damage. Aluminum, steel, wood, plastic and other materials age over time and become weak due to wind, weather, water, acid, alkalinity, constant movement, swaying and purely harsh conditions of mother nature. Every piece of material and equipment has its lifetime limits and when that limit has come, it becomes a safety concern. Helm Marine Inc. is not responsible to communicate equipment safety concerns. However, Helm Marine Inc. may reach out to you to discuss your equipment if Helm Marine Inc. cannot install, remove or service your equipment safely. Helm Marine Inc. is not responsible to secure/tie down docks, boat lifts, pontoons, boats or any other lakeshore property to lake bed/shoreline (Spring Install) or on land/lakeshore (Fall Removal). WARNING - Tornados, straight-line winds, thunderstorms, winds and blizzards are extreme in South Dakota. Helm Marine Inc. recommends all lake property owners/customers to heed this warning and secure, strap, tie-down and anchor all lake equipment in/out of the water, reducing your risk to property and equipment damage. Helm Marine Inc. is not responsible for recovery or damage to docks, lifts, pontoons, boats, PWC’s and other vessels due to weather/Mother Nature. If recovery/salvage is needed Helm Marine Inc. will offer the highest level of service to recover your vessel or lake equipment. However, Helm Marine Inc. is not responsible for any damage in a recovery or salvage event. Helm Marine Inc. reserves the right to refuse service to any person, family, lake homeowner, lake or region for any circumstance deemed necessary.
